These Terms and Conditions ("Terms") govern your use of the IT support services provided by VM Tech ("VM Tech", "we", "us", or "our") and our website, vmtech.ca. By booking or using our services, you agree to these Terms.
1. Our Services
VM Tech provides onsite and online (remote) computer and IT support services, including troubleshooting, installation, maintenance, and related consulting, to individuals and businesses in Greater Vancouver, British Columbia.
2. Booking & Scheduling
Support requests may be submitted through our website booking form, by phone, by email, or directly by your organization's authorized end users through our Desktop Client application. Submitting a request does not guarantee a specific appointment time; we will confirm scheduling with you directly.
3. Pricing & Billing
- Services are billed by time worked, using the billing rates and minimum-block rules in effect for the applicable support type (onsite or online) at the time of service. Current rates are available on request.
- Time worked during each support session is tracked from start to end and rounded according to our standard billing-block rules.
- We issue a monthly invoice summarizing the sessions performed for your account, plus applicable GST.
- Invoices are due upon receipt unless another payment schedule has been agreed with you in writing. Accepted payment methods will be indicated on your invoice.
4. Your Responsibilities
- Please provide accurate contact and billing information, and reasonable access to the device(s), account(s), or premises needed to perform the requested support.
- You are responsible for backing up your important data before any support session. While we take reasonable care, VM Tech is not responsible for data loss that is not directly caused by our negligence.
- You are responsible for ensuring you hold any licenses required for software we may install or configure at your request.
5. Remote Support
Some services are delivered remotely using remote-access software. By requesting online support, you consent to VM Tech technicians remotely accessing the applicable device for the purpose of providing that support.
6. Cancellations & Rescheduling
Please give us as much notice as possible if you need to cancel or reschedule a confirmed appointment, so we can offer the time to another customer. Repeated late cancellations may affect future scheduling priority.
7. Limitation of Liability
To the extent permitted by law, VM Tech's total liability for any claim relating to our services is limited to the amount you paid for the specific service giving rise to the claim. We are not liable for indirect, incidental, or consequential damages, including lost data, lost profits, or business interruption, except where such damage results directly from our negligence.
8. Customer Portal
If we set up a customer portal account for your organization's authorized representative, that account may be used to view your organization's own tickets and invoices. You are responsible for keeping your portal login credentials confidential.
9. Changes to These Terms
We may update these Terms from time to time; the "Last updated" date above reflects the most recent revision. Continued use of our services after a change constitutes acceptance of the updated Terms.
10. Governing Law
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein.
